General Terms and Instructions

The property described on this Internet World Wide Web site will be offered at public auction by iWineBroker.com (herein "the website"/" iWineBroker.com" ), serves as a marketing agent, on behalf of the Seller ,under the following terms and conditions.

Every attempt has been made to describe all property as accurately as possible. However, iWineBroker.com does not warrant or represent, and denies responsibility for the accuracy of the descriptions, encompassing but not limited to vintage, provenance, authenticity, quality and condition, as may be stated on the site. Any and all statements made relating to the property offered on the site are merely statement of opinion and at no time can be construed as warranties and representations of fact or assumptions of any liability on the part of iWineBroker.com.

When a lot description of a bottle includes a photo, the photo may not necessarily show the actual bottle offered in the lot. If the bottle is described as “in excellent general condition,” the photo may be a WineBid.com stock photo of a bottle of the specified wine and vintage, though not the exact bottle offered. Stock photos may be used for bottles that are in “excellent general condition” but have lightly depressed corks, lightly elevated corks, lightly scuffed capsules, lightly depressed capsules, lightly wrinkled capsules, lightly worn capsules, lightly scuffed labels, lightly nicked labels and lightly worn labels.

The definition of status for the wines presented is related to the age of the wine; a decrease in the bottle's fluid level is expected as the age of the wine increases. For bottles less than 20 years old, a fluid level at base neck fill or better fill within 3 cm of the bottom of the cork if the bottle has no shoulder is acceptable. For wines over 20 years old, top shoulder fill or better (within 4 cm of bottom of cork if bottle has no shoulder) is vastly expected. With the progression of age of the wine certain additional changes in color, cleanliness and integrity of labels and capsule and the color of the wine itself should be expected and do not warrant a value decease.

All items are describes as accurately to the date of cataloging, though, from that time to the time of purchasing, some changes in bottle fluid level, cases, labels and/or corks may occur with no relation to any known change in the manner the bottles are stored.

The wine industry estimates that between 3 and 7 percent of all wines sealed with natural corks are ruined because of a natural fungus in corkwood that produces the chemical compound trichloroanisole, or TCA within the cork. TCA has a distinctive odor resembling moldy newspaper or damp basement. In almost all cases of "corked" wine, the aroma of the wine is reduced significantly, and a heavily tainted wine is completely undrinkable. Since all of our wine is consigned, and much of it is very rare, we cannot replace wines that have been ruined because of cork taint. We do not accept returns of corked wine nor do we refund for corked wine.

Delivery – the default method of delivery of the purchased items is customer pick-up from a pre-defined location. The pick-up address and date will be given to the buyer only after a written approval for the full payment, including the buyer's commission, have been received. To the buyer's convenience all items are available for shipping at buyer's own cost and responsibility.

Buying on iWineBroker.com

It is advised that all potential buyers will read the following:

Sale Price - unless otherwise specified, all items presented include such price, marked in US dollars.

Buyer's Premium - iWineBroker.com charges a buyer's premium of 15% +VAT on all purchased items.

Purchasing – acquisitions on the website will only be possible for registered buyers, identified by a unique User Name and Password. All buyers must register prior to their first Purchase. All customers details will remain iWineBroker.com's possession for future purchases and for the purpose of update sent from time to time.

The items will be purchased at the Sale Price shown in US dollars. Payment will be transferred in NIS by the rate of the USD at the day of purchase but not less than 4 NIS to 1 USD. Purchasing on iWineBroker.com is by a Shopping Cart. At Check-Out the buyer will receive his Order's Confirmation, specifying all of the items he/she wishes to purchase and the total sum due including the buyer's premium and other additions (shipping etc.) An iWineBroker.com representative will contact the buyer within 48 hours to complete the transfer of sums.

Payment – the buyer must transfer all due payable sums for the items purchased within 10 calendar days from the date of purchase. Payment is available by Credit Card, Wire Transfer, Personal Check or any other method approved by iWineBroker.com.

Taxes – all payable taxes, duties etc. are the sole responsibility of the Buyer.

Pick-up and Delivery

Shipping can be arranged by contacting iWineBroker.com. For shipping quotes the buyer should mark the Shipping Box in the Check-Out form and request such service when contacted by the web-site representative.

The website is not responsible for any damages caused to items during packing and/or delivery in case such services not performed by iWineBroker.com personnel.

Pick-Up - all purchased items should be picked up by the buyer within 15 calendar days after payment have had been approved and pick-up arranged by iWineBroker.com. Pick-up will be arranged at least 48 hour in advance.

Storage - iWineBroker.com will store all purchased items up to 15 calendar days after completion of purchase, free-of-charge. After this period, every 12 bottles case (or fraction of a case) purchased, will be charged 25 USD per month (or fraction of a month). Storage can be arranged in advance for longer periods of time, for details please contact iWineBroker.com by E-mail/Telephone.

Purchasing terms

This section, in conjunction with all other above mentioned terms, serves as a legal binding contract between iWineBroker.com and the buyer.

Information presented

All buyers are advised to retrieve all information they might be interested in prior to purchasing. Neither iWineBroker.com nor Sellers are responsible for the nature of the purchased items. All items are sold "As Is" without warranty by iWineBroker.com or the Seller.

Purchasing on iWineBroker.com is by a Shopping Cart module. At Check-Out the buyer will receive his Order's Confirmation specifying all of the items he/she wishes to purchase and the total sum due including the buyer's and other additions (shipping etc.) An iWineBroker.com representative will contact the buyer within 48 hours to insure all arrangements are made for the transfer of sums and completion of sale.

By completing the purchasing process within the web-site (check-Out) the Buyer assumes personal responsibly to pay all due sums for the items purchased including the Buyer's Premium. All item presented on the web-site are at very limited quantities and iWineBroker.com is not obligated to any specific item once such items had been sold-out..

Sale Price - all items are presented adjacent to their Sale Price marked in US dollars. Payment will be transferred in NIS by the rate of the USD published at the day of purchase, but not less than 4 NIS to 1 USD. The Sale Price can change from time to time according to iWineBroker.com's own discretion.

The web-site reserve its right to decline any purchase request made, to cancel or change an item at its discretion.

Finalizing the Purchase

Buyer's Premium – Buyer will pay a Buyer's Premium at a rate of 15% +VAT in addition to the Sale Price transferred to the Seller by iWineBroker.com.

Payment – An iWineBroker.com representative will contact the Buyer within 48 hours from the time of Purchase in order to coordinate and arrange the transfer of all due sums including the Buyer's Premium +VAT, to iWineBroker.com. At that time the iWineBroker.com representative will require the Buyer's instruction for Pick-Up/Delivery. The Buyer commits to arrange for the full payment including the Buyer's Premium within 10 calendar days from the date of purchase on the site. After payment had been approved the purchased item will be available for Pick-Up/Delivery within 14 calendar days.

Packaging, Processing and Shipping – iWineBroker.com is not responsible for any damages caused to items and/or any mistake/complaint made concerning processing, caused by a third party (shipping company).

Import/Export and other Licenses - unless other wise agreed upon in writing by iWineBroker.com, submission of application for Import/Export licenses does not remove the buyer's responsibility to settle payment according to the above mentioned schedule.

Non-Payment of the Sale Price and/or the Buyer's Premium entitles iWineBroker.com to take any measure it finds appropriate to protect the rights of the Seller, as well as its own.

Liability

Neither the Seller, the Web-Site nor any company related to it, or any employee of it, are responsible for any statement made in any way, concerning any item, whether in writing or verbal, and denies responsibility for any mistake or failure made in the description of faults of items. The Seller, the Web-Site and/or employees, denies liability of any kind regarding an item concerning its marketability, suitability for a specific purpose, description, quality, current state, and/or rarity. With out conflicting the above written, the Buyer and he/she alone has the right to file a written objection concerning an item bought. iWineBroker.com, at its discretion, can attempt to resolve a dispute between the Seller and Buyer, including cancellation of Sale. In such case, after all sums paid have been returned to the Buyer, the Buyer will have no additional claims and/or demands to the Web-Site or the seller..

iWineBroker.com, is responsible to deliver all information regarding items on sale to the Buyer. Nonetheless, it is clearly stated that the information presented by the Web-Site, in his status of agent for the Seller, is based on the existing information alone. It is understood that when dealing with older vintage bottles, natural changes in the fluid level in the bottle, cork and wine may exist.
Corks older than 20 years tend to lose elasticity and the fluid level in the bottle may change from time of Cataloging to time of Sale. Some older corks may fail during shipping and onwards. No items will be refund, change in price and/or credit for items post shipping.

The court in Tel-Aviv-Jaffa has ultimate and exclusive jurisdiction in any matter between the Web-Site and the Buyer.

The above specified terms and conditions are agreed in full by both parties.
